AD29 Policy "Statement on Intolerance"
"
An act of intolerance refers to conduct that is in violation of a University policy, rule or regulation and is motivated by discriminatory bias against or hatred toward other individuals or groups based on characteristics such as age, ancestry, color, disability or handicap, national origin, political belief, race, religious creed, sex, sexual orientation, gender identity or veteran status."
AD42 Policy
"Discrimination is conduct of any nature that violates the policy set forth (in AD42) by denying equal privileges or treatment to a particular individual because of the individual's age, ancestry, color, disability or handicap, national origin, race, religious creed, sex, sexual orientation, gender identity or veteran status."
Harassment is a form of discrimination consisting of physical or verbal conduct that:
1. Is directed at an individual becasue of the individual's age, ancestry, color, disability, or handicap, national origin, race, religious creed, sex, sexual orientation, gender identity or veteran status.
2. Is sufficiently severe or pervasive so as to substantially interfere with the individual's employment, education, or access to University programs, actiities and opportunitites. To constitute prohibited harassment, the conduct must be such that it detrimentally affects the individual in question and would also detrimentally affect a reasonable person under the same circumstances.'
A 'bias-related incident' is any incident in which an action taken by a person or group is perceived to be malicious or discriminatory toward another person or group based on bias or prejudic relation to such characteristics as race, color, religion, national origin, ancestry, age, mental or physical disability, sexual orientation, gender, or gender identity or any situation in which intergroup tensions exist based on such group characteristics. Bias-related incidents may be violations of criminal law, such as "Hate Crimes," or violations of civil law, such as unlawfule discrimination in employment, housing, education or public accommodations. In Pennsylvania, the legal definition of a hate crime is determined by Pennsylvania's "Hate Crime" Law, the Ethnic Intimidation and Instituional Vandalism Act.
